These Terms apply to bookings, consultations, assessments, programs, and services provided by Brainshape Freshwater (“we/us”). By booking online, purchasing a program or digital product, or attending an appointment, you agree to these Terms.

Bookings and appointments

Online bookings are subject to availability.

You are responsible for providing accurate contact details so we can confirm and communicate about your appointment.

If you book for another person (e.g., your child), you confirm you have authority to do so and to provide required consents.

Fees and payment

Fees are displayed at the time of booking and/or provided by our team.

Assessment, consultation, and program fees may change from time to time. Please check current pricing at the time of booking.

Payment is required on the day of your consultation or as otherwise agreed in writing.

For selected online bookings, a deposit may be required to secure your appointment. Deposit terms will be shown at the time of booking.

If payment plans are offered, they are subject to eligibility and written confirmation.

Cancellations, rescheduling and no-shows

To protect appointment availability for other families, we require notice for changes:

Notice period: Please provide at least 48 hours’ notice to cancel or reschedule your appointment.

Deposits, cancellations and rescheduling

Where a booking deposit applies:

  • Cancellations or rescheduling with at least 48 hours’ notice: the deposit will be refunded or transferred to a new appointment.

  • Cancellations within 48 hours of your appointment, or no-shows: the deposit may be forfeited.

  • Appointments can be rescheduled up to 48 hours before the scheduled time without loss of deposit. Requests made within 48 hours may be treated as a late cancellation.

Refunds are processed back to the original payment method within 3–5 business days where applicable.

We may waive the late cancellation policy in exceptional circumstances at our discretion.

Refunds

Refunds are assessed case-by-case in line with Australian Consumer Law (ACL).

Nothing in these Terms limits your rights under the ACL.

Nature of services

Our services may include assessments, consultations, movement-based programs, developmental exercises, educational support, wellness strategies, and related services.

Services and educational materials are designed to support brain and nervous system development and general wellbeing. They are not intended to diagnose, treat, cure, or replace medical advice or medical care.

Results vary between individuals. We do not guarantee specific outcomes.

Consent and clinical decision-making

We will explain recommended assessments, exercises, and program options. You can ask questions and choose whether to proceed.

If at any time we believe our services are not appropriate for your needs, we may recommend seeking advice from another healthcare or allied health professional.

Children and family appointments

A parent or legal guardian must provide consent for services provided to a minor unless otherwise permitted by law.

Parents or guardians may be required to attend consultations and participate in home-based recommendations or exercises.

Digital products, webinars and eBooks

Any eBooks, webinars, videos, downloadable resources, or educational content we provide are for general educational purposes only and do not constitute personal medical or healthcare advice.

All content is owned by Brainshape Freshwater and must not be copied, reproduced, sold, or distributed without written permission.

Website and online content

Information provided on our website, social media channels, emails, and digital platforms is intended for general educational and informational purposes only.

While we aim to provide accurate and current information, we do not guarantee that all content will always be complete, accurate, or up to date.

Privacy

Our Privacy Policy explains how we collect and handle personal information. By booking or using our services, you acknowledge you have read it.

Liability (to the extent permitted by law)

We take reasonable care in providing our services and programs.

To the extent permitted by law, we are not liable for indirect or consequential loss arising from the use of our services, programs, website, or educational materials.

Nothing in these Terms excludes non-excludable rights under the ACL.

Changes to these Terms

We may update these Terms from time to time and will publish the current version on our website. The Terms in force at the time of booking apply.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales.
